Londres incluye a Gibraltar en su propuesta para el Brexit
La mención expresa a Gibraltar en el documento del Gobierno británico que perfila los derechos que tendrán los ciudadanos comunitarios que residen en el Reino Unido amenaza con volver a colocar el contencioso del Peñón en el arranque de la negociación del Brexit. Fuentes diplomáticas españolas ya han advertido de que “el principio según el cual ningún acuerdo entre la UE y el Reino Unido se aplica a Gibraltar sin un acuerdo previo entre Reino Unido y España no admite excepciones y afecta también a los derechos de los ciudadanos”.
El Gobierno contaba con que la decisión del Consejo Europeo de incluir en las directrices del Brexit el derecho de veto de España sobre la aplicación a Gibraltar de los futuros acuerdos entre la UE y el Reino Unido permitiría aparcar el problema hasta el final de la negociación.
Sin embargo, el documento de 15 páginas del Gobierno de Theresa May que perfila su oferta sobre el futuro estatuto de los ciudadanos comunitarios residentes en el Reino Unido cita en dos ocasiones a la colonia.
El texto asegura que “los acuerdos recíprocos [entre Reino Unido y la UE] sobre derechos de los ciudadanos se aplicarán al conjunto de Reino Unido, que cubre Escocia, Gales, Irlanda del Norte y todas las partes de Inglaterra, y Gibraltar”
El documento hecho público por Londres refleja la posición británica, pero la de la UE está claramente definida en las directrices para el Brexit aprobadas el pasado 29 de abril por el Consejo Europeo, en las que se dice que “después de que el Reino Unido abandone la UE, ningún acuerdo se aplicará a Gibraltar sin un acuerdo entre España y Reino Unido”.

The mention of Gibraltar in the document of the British Government that outlines the rights that will have the citizens of the EU residing in the United Kingdom threatens to reinstate the contention of the Rock at the start of the negotiation of the Brexit. The Government hoped that the decision of the European Council to include in the Brexit guidelines Spain’s veto right over the application to Gibraltar of future agreements between the EU and the United Kingdom would allow the problem to be dealt with until the end of the negotiation.
However, the 15-page document of the Government of Theresa May outlining its offer on the future status of EU citizens resident in the United Kingdom cites the colony twice.
The text states that «reciprocal [UK-EU] agreements on citizens’ rights will apply to the United Kingdom as a whole, covering Scotland, Wales, Northern Ireland and all parts of England, and Gibraltar»
The document made public by London reflects the British position, but the EU position is clearly defined in the guidelines for the Brexit adopted last 29 April by the European Council, which states that «after the UK leaves The EU, no agreement will apply to Gibraltar without an agreement between Spain and the United Kingdom. »
